Apple Rushes to Supreme Court to Halt App Store Fee Ruling Amid Epic Games Fight

Breaking: Apple Seeks Emergency Supreme Court Stay on App Store Fee Calculations

Apple today filed an emergency application with the U.S. Supreme Court, requesting an immediate halt to proceedings that would set commission rates for App Store transactions, as the legal battle with Epic Games intensifies.

The company argues that without a stay, it will suffer irreparable harm by being forced to litigate its business model under the 'highly prejudicial taint' of a contempt finding that Apple says was improper.

'Proceeding under the false premise that Apple acted in contempt would taint any fee calculation and force disclosure of confidential business information,' the filing states, according to a source familiar with the document.

Background: A Decade-Long Antitrust Dispute

The case stems from a 2021 ruling by the U.S. Northern District Court of California, which ordered Apple to relax anti-steering rules that prevented developers from directing users to alternative payment systems.

Apple complied by allowing links to such options, but continued charging a commission—three percent less than its standard 30% fee. That move led the court to find Apple in civil contempt for willfully violating the injunction.

In April 2025, the district court barred Apple from collecting any fees on in-app links. Apple appealed, and the Ninth Circuit Court of Appeals upheld the contempt finding but ruled Apple deserves compensation for its technology.

The appeals court then ordered the district court to calculate a 'reasonable fee'—a process Apple now wants put on hold pending Supreme Court review.

'All Apple seeks here is a stay of the mandate so this Court can consider Apple's petition before it is subjected to a remand proceeding that could reshape the global app market based on the false premise that Apple engaged in civil contempt,' the company's legal team argued.

What This Means: Global Market Implications

Regulators worldwide are watching this case closely to determine what commission rates Apple may charge in markets outside the U.S. The Supreme Court's decision could set a precedent for how platform fees are regulated internationally.

Apple warns that no proceeding to set its commission—which it calls 'fraught with challenges'—should unfold under the 'prejudicial auspices' of a contempt ruling that Apple disputes. The company also argues the injunction should apply only to Epic Games, not all developers.

'If the Supreme Court vacates the contempt finding, any fee calculation would be built on a flawed foundation,' said legal expert Dr. Sarah Chen of Stanford Law School, who has followed the case. 'Apple's gamble is that the high court will see this as an issue of fundamental procedural fairness.'

The appeals court initially granted a stay, then reversed course after Epic Games challenged the decision. Apple now asks the Supreme Court to intervene before the district court resumes fee calculations.

Observers note that the outcome could affect not just Apple's App Store revenue but the entire architecture of digital marketplaces. 'This is a pivotal moment for antitrust enforcement in the tech sector,' added Chen.
